Terms and Conditions of BirdLife Australia’s Aussie Bird Count 2026 Prize Draw 

  1. The promoter is: BirdLife Australia, ABN: 75 149 124 774 whose registered office is at Level 2, Main Building, 54 Wellington Street, Collingwood VIC 3066. 
  2. The competition is open to residents of Australia except board directors, committee members and employees of BirdLife Australia and their immediate families.  
  3. The promoter reserves the right to request verification of the identity and residential address of winners and any other information relevant to entry into or participation in this competition and to disqualify any individual who submits an entry that is not in accordance with these terms and conditions. 
  4. There is no entry fee and no purchase or donation is necessary to enter this competition.  
  5. By entering this competition, an entrant is indicating their agreement to be bound by these terms and conditions.  
  6. In order to enter this competition, entrants must submit a count to the Aussie Bird Count via the app or website. Details of how to enter are via https://aussiebirdcount.org.au/.   
  7. Only one entry will be accepted per person. Multiple submissions will count as a single entry per person. Each entrant is eligible to win a maximum of one prize.  
  8. Closing date for entry will be 23:59 (AEDT) Wednesday 28 October 2026. After this date no further counts/entries to the competition will be permitted.  
  9. The promoter reserves the right to cancel or amend the competition and these terms and conditions without notice in the event of a catastrophe, war, civil or military disturbance, act of God or any actual or anticipated breach of any applicable law or regulation or any other event outside of the promoter’s control. Any changes to the competition will be notified to entrants as soon as possible by the promoter. 
  10. The total prize pool value is $1,395.  
  11. The prizes are as follows: OM SYSTEM 10×50 S Binoculars – RRP $279. Quantity: 5.  
  12. The prizes are as stated and no cash or other alternatives will be offered. The prizes are not transferable. Prizes are subject to availability and the promoter reserves the right to substitute any prize with another of equivalent value without giving notice.  
  13. The promoter is not liable for any loss, damage or injury suffered in connection with entering this competition (including technical malfunctions, communications failures, or system errors that may affect entry submission or participation), acceptance or use of a prize by a winner or the conduct of a prize supplier, except for any liability which cannot be excluded by law.  
  14. The draw will take place on Friday 30 October 2026 at Level 2, Main Building, 54 Wellington Street, Collingwood VIC 3066. Winners will be selected at random using computer-generated randomisation. Prizes will be drawn in order. The first valid entry drawn will receive Prize 1, the second valid entry drawn will receive Prize 2, and so on until all prizes have been allocated.   
  15. Winners will be notified in writing using the contact details provided by the entrant in their entry form as soon as practicable and no later than 7 days after the draw. If the winner cannot be contacted or does not claim the prize within 28 days of notification, the promoter will conduct a redraw on 11 December 2026 following the process set out in clause 14.  
  16. The promoter will notify the winners when and where the prize is delivered. 
  17. Subject to applicable law, the promoter’s decision in respect of all matters to do with the competition will be final and no correspondence will be entered into. 
  18. The competition and these terms and conditions will be governed by the laws of Victoria and any disputes will be subject to the exclusive jurisdiction of the courts of Victoria. Nothing in these terms and conditions limits any rights or remedies an entrant may have under the Australian Consumer Law.  
  19. The winners agree to the use of their name and image for promotional purposes associated with the Aussie Bird Count.  
  20. The first initial, surname and postcode of winners will be published on the Promoter’s website at aussiebirdcount.org.au within 30 days of the draw. The winner’s names will be available on the website for 28 days after publication.  
  21. Entry into the competition will be deemed as acceptance of these terms and conditions. 
  22. By entering the competition, entrants consent to the collection, use and disclosure of their personal information for the purposes of administering the competition, awarding prizes and complying with relevant laws. Personal information will be handled in accordance with the promoter’s Privacy Policy found at https://birdlife.org.au/privacy-policy
